The law prevents an employee from treating an employee different then their other employees if the disparate treatment is based on their age.  The key to age discrimination is that the person being discriminated against must be 40 years of age or older.  For example if an employer prevents anyone who is older than 55 to take paid vacations than this would be a violation of the law.  Even if the employer treated people between the ages of 40 and 55 fairly, he or she would still be guilty of discrimination because the person being discriminated against is over the age of 40. 

The current laws do not protect discrimination on the basis of age for people under the age of 40 years old.  Currently an employer is not barred from discriminating against potential employees or employees if they are under the age of 40.  If you feel that you have been a victim of age discrimination you need action and you need justice.
