The Americans with Disabilities Act and the Pennsylvania Human Relations Act prevent discrimination based on disability. The first question that must be asked in any disability claim is whether the person making the compliant has a disability as defined by the state and federal law. In order to qualify as disabled a person must suffer from a disability that affects a “major life activity.” Secondly the ability to perform that activity must be substantially impaired. An employer cannot fail to hire, promote, give a raise to or terminate an employee because they are disabled. Additionally an employer may not discriminate against an employee because they are perceived as disabled. For example, if an employee does not actually suffer from a disability but his or her employer believes that they are disabled and they discriminate against them then this would be a violation of state and federal law.
