The Equal Employment Opportunity Commission and the Pennsylvania Human Relation Commission or the Federal and State administrative bodies that investigate and make findings on alleged discrimination cases. For most forms of discrimination the complaint must first be filed with these agencies before a civil complaint can be filed in either the federal or state court. These agencies have a set amount of time in which to complete their investigations and issue findings. If they find that a violation has occurred then they will urge both parties to reconcile and come to an agreement. If they find that a violation has not occurred then they will so indicate in their report. Even if these agencies find that there was not enough evidence to establish a violation of civil rights, this does not prevent a person from filing an action in the state or federal civil court. If the agencies find that a violation has not occurred they will issue notice to the complainant that they now have the right to sue.
A potential complainant has a limited time period in which to initiate an action for discrimination. Under the Equal Employment Opportunity Commission guidelines a person who has been discriminated against must file a claim with them within 300 days after the alleged misconduct. If the claim is not filed within this time period then the employee may be barred from filing a lawsuit against the party that discriminated against them.
Under the guidelines of the Pennsylvania Human Relation Commission, a potential complainant must file a complaint with them within 180 days after the alleged misconduct. If a complaint is not filed timely then the person could be barred from filing a lawsuit against the party that discriminated against them.
