Wage & Hour Disputes

Wage and Hour Disputes in Chester County

Speak to West Chester PA Wage & Hour lawyer Steve Jarmon for reasonable legal advice and representation on questions about wage and hour disputes including claims for unpaid overtime.  The FLSA establishes what the minimum wage is, what workers should receive for overtime pay, recordkeeping, and standards for youth employment affecting employees in the private sector and in Federal, State, and local governments. Covered workers who are not exempt are entitled to a minimum wage of at least $6.55 per hour effective July 24, 2008; and at least $7.25 per hour effective July 24, 2009. Overtime pay at a rate of at least one and one-half times the regular rate of pay is required after 40 hours of work in a workweek.  For example, if an employer is forcing all his employees to work more than 40 hours a week and it not providing them with overtime pay, then that employer may be in violation of this act.

The Fair Labor Standards Act requires that “nonexempt” employees be paid time-and-a-half their regular rate for working more than 40 hours a week. Jobs that can be exempt from the overtime requirements include managers who actually perform managerial duties, administrators, learned professionals and similar people. Just because you are paid a salary, does not mean your job is exempt from the requirement that overtime be paid time and a half. Exemptions are fairly technical, and legal advice is important. Do not make your own decision on whether you are covered by an exemption.

Steve Jarmon aggressively prosecutes an employer who commits Fair Labor Standards Act (FLSA) violations with the same prosecutorial zeal he used as a former prosecutor.  Do not be the victim of an employer exploiting your employment by underpaying you and cheating you out of the overtime you deserve.  Do not let an employer misclassify you as salaried but then dock you for partially missed time like you are an hourly employee.  Even a salaried employee can be entitled to overtime and you need an experienced attorney to give you important legal advice.  Schedule an appointment with Mr. Jarmon at one of our three Chester County locations in West Chester, Kennett Square and Exton PA.
